Massachusetts revocable living trusts
A hallmark of Massachusetts revocable living trusts is that for married persons, each of them generally get their own trust document. This is different from the single trust that married persons in California typically get.
This is because in California, the property system is community property, rather than the separate property system we have in Massachusetts.
The reasons we use a separate trust for each person, whether married or single, is that you want a trust that many Massachusetts estate planning attorneys are familiar with. This is the separate Massachusetts revocable living trust, rather than the joint, single trust frequently used in California and other western U.S. states.
